What Is Considered Medical Malpractice?

Medical malpractice occurs when a doctor, nurse, hospital, or other healthcare provider fails to meet the accepted standard of care, causing injury or death to a patient. In other words, when a medical professional acts (or fails to act) in a way that another reasonably competent provider would not under the same circumstances, it may be considered negligence.

Because every case is different, determining whether malpractice occurred often requires a detailed review of medical records and expert insight. That’s where a skilled medical malpractice lawyer becomes essential.

Common Types of Medical Malpractice

Medical negligence takes many forms. Our attorneys handle cases involving:

  • Misdiagnosis or delayed diagnosis, such as failure to identify cancer or heart disease within a reasonable time.
  • Surgical errors, such as operating on the wrong body part, leaving surgical tools inside a patient, or other critical mistakes.
  • Medication errors, like wrong prescriptions, incorrect dosages, or dangerous drug interactions.
  • Birth injuries, including harm to a mother or newborn, caused by negligence during labor or delivery.
  • Anesthesia errors, such as mistakes that can cause brain damage, cardiac arrest, or even wrongful death.
  • Failure to obtain informed consent when a provider performs a procedure without explaining the risks.
  • Failure to monitor, such as neglecting to track a patient’s condition or respond to warning signs.

If your situation doesn’t fit neatly into one of these categories, don’t worry. Our team can still evaluate your circumstances and help you understand your legal options.

How to Know If You Have a Case

If you’re unsure whether your experience qualifies as malpractice, our attorneys start by evaluating three key elements:

  1. Standard of Care: Was your healthcare provider’s treatment consistent with what another competent professional would have done?
  2. Negligence: Did the provider act carelessly or make an avoidable error?
  3. Causation and Damages: Did that negligence directly cause your injury, financial loss, or suffering?

If you think you’ve been harmed by medical negligence, don’t wait. Reach out now so our team can begin investigating before crucial evidence is lost.

Common Questions About Medical Malpractice

What Qualifies as Medical Malpractice?

Medical malpractice occurs when a healthcare provider fails to deliver treatment that meets the accepted standard of care, resulting in pain, injury, or death.

How Do I Prove a Medical Malpractice Claim?

You must show that your provider acted negligently, that their actions directly caused your harm, and that you suffered measurable damages. Expert medical testimony is typically required.

How Long Do I Have to File a Malpractice Lawsuit?

While Alabama and Georgia share some similarities, such as a statute of limitations of two years from the date of injury, key differences in each state’s laws can impact your case.

  • In Alabama, you may have up to six months after injury discovery to file a lawsuit, provided the injury was not reasonably discoverable within the two-year statute of limitations period. Additionally, Alabama offers an absolute deadline of four years after the error date, regardless of when the error is discovered.
  • In Georgia, there is no broad “discovery rule,” and the two-year statute of limitations period begins from the date of harm, regardless of when the patient becomes aware of it. However, if the harm was not reasonably discoverable within that timeframe (such as a piece of medical equipment left inside the patient during surgery that is only discovered during imaging years later), the time frame for filing may be extended. The statute of limitations may also be extended if the healthcare provider intentionally hides their negligence. The time limit to file does not apply for children under 5 years of age. However, once the child turns 5, the 2-year countdown begins.

Since these deadlines can vary, contact a medical malpractice attorney immediately to protect your rights.
